Terms of Service
These Terms of Service ("Terms") govern your use of Viamoda, a professional networking and collaboration platform for the modeling industry operated by Ponsomni LLC ("Viamoda," "we," "us"). By creating an account or using Viamoda, you agree to these Terms and to our Community Guidelines, which form part of these Terms.
1. Eligibility
You must be at least 18 years old to create an account or use Viamoda. By using Viamoda you represent that you are 18 or older. Accounts identified as belonging to anyone under 18 will be restricted or removed.
2. The service
Viamoda lets models, photographers, brands, and agencies create professional profiles and portfolios, discover one another, and communicate. Viamoda is a networking platform only:
- Viamoda is not an employer, talent agency, or manager, and does not represent any member.
- Viamoda is not a party to any arrangement — including shoots, campaigns, bookings, or contracts — that members enter into with one another. Members deal with each other directly and at their own responsibility.
- Viamoda does not guarantee work, bookings, exposure, or opportunities.
3. Your account
You are responsible for your account and for keeping your credentials secure. Your account information must be accurate, you may not impersonate any person or organization, and you may not create an account for someone else or transfer your account.
4. Your content
You retain ownership of the content you post — photographs, portfolio work, profile information, and messages. By posting content on Viamoda, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content as needed to operate and provide the platform. You are responsible for the content you post, and you represent that you have the necessary rights to it — including, for photographs, any rights or consents required from the people who appear in them.
5. Acceptable use
You agree to follow the Community Guidelines. Among other things, you may not use Viamoda to harass, exploit, or deceive others; post content that is unlawful or sexually explicit; solicit upfront fees or payments for purported opportunities; misrepresent who you are; or interfere with the operation or security of the platform.
6. Verification
Certain account types are subject to verification processes, and certain features — including some messaging — may be unavailable until applicable verification requirements are met. Verification reviews submitted information only. A verified status is not an endorsement by Viamoda and is not a representation that any member is safe, trustworthy, or legitimate. We may decline, revoke, or re-require verification at our discretion, including where information changes or a process is later found to have been misused. Identity verification for photographers is performed by a third-party provider under its own terms and privacy policy.
7. Subscriptions
Viamoda offers optional paid subscriptions purchased through Apple's App Store. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your App Store account settings; payment and refunds are handled by Apple under Apple's terms.
8. Moderation and enforcement
We may review content on the platform, including through automated moderation systems. We may remove content, restrict features, suspend accounts, or terminate accounts that violate these Terms or the Community Guidelines, or where we reasonably believe action is needed to protect members or the platform. You may stop using Viamoda and delete your account at any time from your account settings.
9. Disclaimers
Viamoda is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-interruption of the service. We do not warrant the conduct, identity, or qualifications of any member, and interactions between members — on and off the platform — are at members' own risk.
10. Limitation of liability
To the fullest extent permitted by law, Ponsomni LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, opportunities, or data, arising out of or relating to your use of Viamoda — including disputes or interactions between members.
11. Governing law
These Terms are governed by the laws of the United States and of the state in which Ponsomni LLC is organized, without regard to conflict-of-laws principles.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the date at the top of this page, and for significant changes we will provide additional notice within the app or by email. Continuing to use Viamoda after changes take effect means you accept the updated Terms.
